Your name and contact info will not be shared or sold with any third-party companies or individuals.
LICENSE GRANT.
Destiny grants to you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the object code copy of the Product distributed with this Agreement (the "Copy") along with related documentation during the term of this Agreement on a single CPU, which CPU you may change from time to time. Such license shall be terminable as provided herein.
You must not remove, from any copies of the Product, any copyright and other proprietary rights notices which appear on the Product as originally provided by Destiny.
If Destiny provides you with any error corrections, updates or upgrades to the Product, such error corrections, updates or upgrades shall be considered part of the Product for the purposes of this Agreement, except as may be otherwise indicated by Destiny.
RESTRICTIONS ON USE.
Unless expressly permitted by this Agreement or otherwise by applicable law, you shall not: (i) use, reproduce, modify, adapt, translate, update or transmit the Product, in whole or in part; (ii) sell, rent, lease, license, transfer, distribute, or otherwise provide third parties with access to the Product; (iii) alter, remove, or cover trademarks or copyright or other proprietary notices in or on the Product; (iv) export the Product from the country in which it was provided to you by Destiny; (v) distribute the Product to thirds parties or make the Product accessible to third parties via the Internet or any web site; or (vi) decompile, disassemble, decrypt, translate, create derivative works from, extract or reverse engineer the Product, or attempt to, or assist others to, do any of the foregoing.
WATERMARKING.
THE PRODUCT CONTAINS CODE WHICH WATERMARKS ANY AUDIO OR VIDEO CONTENT THAT YOU TRANSFER TO UNPROTECTED FORMATS (SUCH AS CD OR UNPROTECTED MP3) USING THE PRODUCT. THE WATERMARKS INCLUDE YOUR ACCOUNT IDENTIFICATION, SUCH THAT ANY COPIES MADE CAN BE TRACED TO YOU. YOU MUST NOT USE THE PRODUCT TO CREATE CD'S OR UNPROTECTED MP3'S EXCEPT FOR YOUR OWN PERSONAL USE AND THE BROADCAST USE OF THE RADIO STATION, IF ANY, FOR WHICH YOU WORK. YOU MUST NOT SELL OR DISTRIBUTE SUCH CD'S OR UNPROTECTED MP3'S, OR ANY AUDIO OR VIDEO CONTENT THAT YOU DOWNLOAD USING THE PRODUCT, TO ANY THIRD PARTY, NOT CREATE DERIVATIVE WORKS FROM SUCH CD'S OR UNPROTECTED MP3'S, OR OTHER AUDIO OR VIDEO CONTENT.
LIMITED WARRANTY.
Destiny cannot warrant that the Product will function in accordance with related documentation in every combination of hardware platform, software environment, and Product configuration. You acknowledge that software bugs are likely to be identified when the Product is used in your particular application. You therefore accept the responsibility of satisfying yourself that the Product is suitable for your intended use. Destiny is not responsible for media defects that result from accident or abuse. Destiny has no obligation under this Agreement to provide maintenance, support, or training.
